Tips on Buying Cars: defective car, defective car, side tire

Question
We recently bought a used truck from a dealership. The purchase price was around $15,000 and we paid for it, in full, the date of purchase. Two days after we purchased the truck, the engine light came on, and as we were driving, the rear driver side tire came off! Yes, lugnuts and all, as we drove down the highway! Needless to say, we had it towed back to the dealership. The next day we called and told them what happened and the truck had been brought back. We were told we would get a call back from a manager when they got there. The following day, a gentleman called, and told us "he didn't know what to say. Someone was clearing playing a joke on us and must have done this in our driveway!" No apology, no asking if anyone was hurt, nothing. My fiance was so upset the way they responded he called the bank and stopped payment on the check. We then went into the dealership and told them we didn't want the vehicle, that obviously we couldn't trust them to make sure we would be safe in a vehicle from them. They then told us was had to take the truck or they would consider it abondoned. We told them we were uncomfortable with the accusations they made to us, and no longer wanted the truck. They told us too bad. What are our rights being we payed out right for the truck? Can they make us take it?

Answer
Hi Kira

your question really is a case that should be discussed with a law firm that deal with vehicle issues to see if misrepresentation was involved.

The dealer is playing hard ball with no compassion, if you bought the vehicle " as is " or with no warranty's you may be out of luck.

As for you to cancel cheque I will be very surprised if dealer did not secure funds when you took delivery.
