Used Cars: DEQ/Oregon, deq oregon, emmissions

Question
I recently purchased a used car from a lot.  I was informed I needed to take it through emmissions and then bring the certificate back to the lot(I had to pay for the certificate myself) This was all done after I had signed all the paperwork and he had issued a 90 day trip permit. I had the truck for about 5 days and the check engine light came on. I had gotten a code saying "cylinder 1 misfire" I took it back to the lot and they acted like they were fixing the issue. The light went out and 2 days later came back on with the same code coming up. I took it back to the lot and they replaced a spark plug, at my expense. Two days later the light came back on with the same code and this time I have taken it somewhere else. What are my options in getting the lot to pay for fixing my truck. If I try to take it through emmissions again with the light on and it idling so rough it will probably not pass. Since I took it through and it passed when I bought it do I still have with in 60 days to have it retested. Since it has only been 2 weeks since I bought the truck  what are my options for getting them to repair the issue with the check engine light coming on. I bought the truck "as is" with no sticker in the window and was told that there were no issues and the truck ran great.

Answer
Hi Sharon,

Sorry to hear about your troubles with a persistent check engine light. From the gist of your question it sounds like you bought the truck and then had the light come on 5 days later ...took it in and they turned it off ...it came back on ...you took it in and they changed 1 plug...2 days later it was back and you took it somewhere else etc... AND somewhere along the line you did run it through DEQ and it passed. If that is correct then here is where you are with this:

The dealer is responsible for getting any vehicle he sells to pass DEQ if its required. When we sold a car that had bad plates and needed to go through we would issue the customer a 20 day trip permit and tell them to pay the $22 fee and when they brought us the certificate showing that it passed we would then issue a 90 day temp and process their title work thru DMV (BTW I am in Oregon too)We would also pay them back their $22 fee when they brought us the certificate back.

Judging from my interpretation of your email your truck passed DEQ and even though it would not pass again right now the dealer is technically off the hook. If you want to email me the name of the store where you bought the truck I have been a dealer in the DEQ zone of Oregon for 20 years and probably know him or if you are lucky know him well ...have beers with him on Saturdays for football and can get him to step up and fix it for you. (my direct email is roadloans@gmail.com) barring that I regret to tell you that a dealers responsibility for check engine lights etc end at the curb or in the case of getting the car through DEQ ...he is on until it passes. If I misread your email and those aren't the facts then please hot me back asap and I will revise my answer ...oh and you should not have had to pay for the spark plug job either. I am with you on this until you are completely satisfied with the answer (even if you don't like it :( ) so when you get a survey from allexperts you can confidently and proudly give me perfect 10's and maximum bonus points

Thanks for your question

Roger
