Used Cars: Used car bad brakes, chrysler srt8, 2007 chrysler 300

My brother just bought  used 2007 Chrysler SRT8 300, about 2 weeks ago, it had less then 1000 miles since he got it. the brakes were squealing and he had 2 shops look at it, both shops said that the brakes are shot the are almost metal on metal. he went back to the dealer he bought it from and they have been giving him the run around all day today, they told him yesterday to bring it today they will replace them, when we showed up today they told him there is no warranty on the car, I am 100 % the car will fail for brakes at NJ inspection, is it true that if it fail the dealer has to cover it?  and do you have any suggestions ?

All cars have a "IN SERVICE DATE", this means what day/mth/yr the warranty started with the mfg. We need to find this out from a Chrysler Dealer. There is no way a set of brakes are out in 1000 miles, no way. We need to find out where this car originated from? You can pull a DMV record on it or a car fax or look at the title (The bank,if there is a lean). Did you buy this car from a dealer or a used car lot? I think there is something funny about this car that is not being disclosed to you!
