Used Cars: I bought a death trap!!, suicide doors, door latch

QUESTION: I bought a truck March 28th, 2008 it had a hinge pin missing from one of the suicide doors. We thought ok they just left it out when they detailed it. The Auto Check came back it was a one owner no problems reported. They kept the truck for a week to fix the door, check transmission, other minor things.

We got the truck back and it would shake and make noise when you turned sharp, and the drivers door wouldn't shut correctly. We called them and took it back. I ran a CarFax report on it and it showed that it had been wrecked with "extensive damage" I told them about this they said they would replace the doors. I took the truck to them again they kept it for a week. In their door replacement, the hinge was broke and door latch was filled full of grease so it would shut better.
I took the truck to two different body shops after this and they both said it had major frame damage and front suspension damage and wouldn't even attempt to repair it. They even said and I quote "I wouldn't let my family ride in it" and went on to say get rid of it as soon as possible. I told the dealership I bought it from what they said and they so graciously offered to make a few payments so I would keep this truck. What do you suggest I do in this situation.

I live in Alabama.
There was no sticker in the window that said "as is" or "warranty"


ANSWER: Well if you havent made a payment, I would not.  That is probably why they are offering to make a few payments, so that your ownership of the vehicle would be more solidified.  I dont know Alabama laws, but here in Oklahoma, if there was no as-is disclaimer signed by you, they can get in trouble.  If I were you I would raise hell with the dealership as soon as you can, and just dont settle for anything less than NOT being in that truck.  If you are unsuccessful I would report them to Used Car Commission in Alabama.  I do not know the "exact" name of the office in alabama, but I am sure it would not take much for you to find out.  As previously stated, each state is different, but here in oklahoma, they would not get by with that.  I am not saying there is a law giving you 30 days to back out of the deal, but that is about the time frame you realistically have a chance of getting something done, so raise hell A.S.A.P.  Good luck and I hope you get out of that truck.

QUESTION: Well, I went back to the dealership and they bought the truck back from me. They even had me new truck same make model and yr with more miles on it waiting for me to take possession of.

When it came time to do the paperwork it COST MORE than the frame damaged one!! And then they back dated the paperwork for the day before. It's all dated for the 2nd of April. Today is the 3rd!!

I just really don't know what to do. I don't remember an as-is disclaimer if I signed one it's not in my paperwork and I think I got a copy of everything.

If I hire an attorney I'll still be out of a truck and that's how I make my money. So It's damned if I do and damned if I don't.

Okay...you lost me.  They bought the frame damaged truck back from you?  If so, that should be a major relief.  And I can definetly understand a truck with more miles, and no frame damage costing more, that is plenty fair.  So did you buy the other truck?
