Used Cars: auto sale gone bad, small claims court, outsite

my son went in the military, before he left we made an agreement to sell his car to my son inlaw who has since become my ex son inlaw,I have the car title,registration & insurance in my name, now the car & ex son inlaw seem to have disappeared, I believe that if i cancel the insurance on the car, I will still be responsible for the car being in my name, my question is, can I turn the car in as stolen? he has only paid $1000 of the $2700 agreed price along with $60 month for insurance & the payments have stopped.

I believe this would be more of a small claims court sort of thing, if you go through the court system i assume they would track him down in order to give him some sort of notice to appear.  I hope you have some of this written down if you want your money, and if you have none of this written down... well you have two choices.. if none of it is documented you could report it stolen & the kid will be arrested (but if he has documentation he can sue you for getting him arrested.. probably wouldn't win, but he could do it) - or you can take it to court and hope you win -  My suggestion is to first call the local police/sheriff and explain the situation (they can tell you if reporting it stolen is the right thing to do, or if going to court is) - and IF they don't give you any information, call the local court office/house AND/OR the DMV - one of those should offer some advice/help... Laws vary by state/county.. and the documentation can play a big part (without a written and signed document.. in the laws eyes, that car belongs to you 100%).. Call those people and tell them the situation, they will know more about what to do than anyone outsite of the system.  (if they still dont help, call a law office, they are a last resort because they are only interested in money, but still should know what to do... they might not mention if there is a cheaper way though) - sorry I can't be of more help, this is beyond my range of knowledge, but I tried to offer suggestions of how to get your answer.  I am sorry for your situation, this is where documentation is key, and doing it properly (signing title, etc) even with family is important.. and im sure you know that now... Good luck! and if you have signed papers.. find them.  Aslong as that car is in your name... its yours... and you are responsible for it...
