Trucking: o/o vs. motor carrier, transportation intermediaries association, fmcsa

Question
just a quik addtional question. if we have o/os hauling loads for us is that considered brokerage in wich we would have to be lisenced and bonded or is it only brokerage if we find them loads out side of what we wre hired to haul
                  thank you

Answer
If you hire an owner operator they are acting as a contractor to you, so the freight has to move under your operating authority, insurance and tariffs.  If you broker a load the underlying carrier operates under his authority and insurance and you get a commission for being the middle man.  A good source of information is The Transportation Intermediaries Association (TIA) http://www.tianet.org/tia.asp
Another goos asource is the FMCSA web site: http://www.fmcsa.dot.gov/factsfigs/faqs.asp
Hope this helps.
