How to Return a Used Car in Indiana

If you have a problem with your used car in Indiana, there is a lemon law that protects you. If your car becomes defective and the warranty is still valid, you can return it to the manufacturer for a refund or replacement. You need to follow the correct procedures to resolve the problem with your used car.

Step 1: Report the issue to the manufacturer.

Report the issue within 18 months after the date of delivery or 18,000 miles driven on the vehicle. Provide the manufacturer with proof that you have made a total of four attempts or tried for 30 days to solve the problem. Provide an explanation as to why you need to return your car.

Step 2: Keep records.

The records should show each attempt you made to have your car repaired. These documents are vital, as they will be used to qualify your car as a lemon. You should have a warranty that covers the car. If the car shows any issues covered by the warranty, report them to the manufacturer.  Per Indiana's lemon law, the manufacturer should replace your vehicle with another one of similar value or accept the return of the vehicle and return the amount you paid less any offset for your usage of the car.

Step 3: Attempt to reach a settlement.

An informal resolution between you and the manufacturer may prove the best solution.

Step 4: Provide a written notice.

Check the owner’s manual or your warranty to see if a written notice is required before you get a refund or replacement. In case a written notice is not required, you can file a lawsuit without giving the manufacturer notice.

Step 5: File a lawsuit.

If the manufacturer denies your claim, you can file a lawsuit within two years since you first reported the issue with your car.
