How to Proceed After a Car Accident

Being in a serious car accident is a traumatic experience. Making sure to take appropriate steps after the accident will ensure that, if warranted, a proper settlement will be reached.

  • First of all, if you are able, ask for help. However, avoid trying to get up if you are seriously injured. If necessary, request that an ambulance take you to a hospital. If you leave the scene of your car accident, you will have less of a case.

  • See a doctor immediately. Make sure the doctor documents your injuries in a written report. Do not wait to see a doctor, the longer you wait from the time of the accident until you see a doctor, the more difficult it becomes to prove that the car accident caused your injury.

  • Don't discuss or minimize your injuries. Don't say "It's all right", or "I'm okay". The insurance adjuster may get wind of these and it could significantly reduce your claim.

  • Take photos of your injuries immediately after the car
accident if you are able. This is great evidence for your case. Wounds heal pretty quickly, but a color photograph will give a great representation of your injuries sustained from the car
    accident.

  • Speak to a lawyer immediately. Most lawyers charge a contingency fee, i.e., a percentage, bigger settlement offers are made to claimants who are represented by lawyers. They may take as much as 40%, but it will be worth it.

  • Make sure you document all of your medical expenses and the actual damages to your car. This will greatly increase the amount of money offered in the settlement.

  • Resist settling a claim too early. You should not accept a claim within the first month after the car accident. You need time to assess the damage, not only in terms of your injuries, but also, lost wages, whether you will need prolonged medical treatment etc. Take your time, and don't rush to be done with the process. Though it is a nuisance, you will be glad you took the time, and got the best settlement possible for your situation.
