Auto Insurance Claims: Settlement, medical costs, car accident

My girlfriend was in a car accident a couple of weeks ago and the insurrance company totaled her car out.  she owes 14k and they want to settle for 12k.  She was not at fault and I guesse what iam getting at is should she go after the other 2 parties for punitive and medical costs for her and the remainder for the vehicle cost?

The best advise I can suggest is have her contact a lawyer because it will mater the state she is located in. As for the value they are diving and what she owes might be her problem.

As for punitive is to punish and a court would need to determine if there was cause from intent to punish. I think the word you are looking for is compesatory.
