Auto Insurance Claims: UIM claim, claims advice, claim help

I had an accident in my vehicle which was insured under my name.  The other driver was a fault and is willing to settle at the limit of his liability coverage.  I am seeking a UIM claim as this settlement won't cover medical costs.  

My question is: can I claim UIM from a different policy on which I am insured?  I have heard of UIM stacking on various policies for different vehicles.  Does this still work if the other vehicle belongs to my parents but I was insured at the time of the accident?

Hello Dave,

You don't mention what state you are in, so I will give you a generic answer.  Understand, however, that state laws do vary.

You were in your vehicle, so your policy would apply.  If you have UM coverage on your policy, that would apply to you.  

As to your parent's policy, I don't see how you would have any coverage there. Are you named on their policy?

As for stacking, in my experience I am aware only of UM stacking vehicles within the same policy.  That means, if you have 2 vehicles listed on a policy, each with liability and UM coverage, the amount of your potential benefits stacks for the coverage on each vehicle.  Example, 2 vehicles at $50K equals limits of $100k.  Of course, all of this is dependent on the other driver being declared at fault, with no or minimal insurance coverage.
