Question
If an insurance company already denied a claim to someoneone that was in a car accident, because the insurance company from the claimee responsable, can the claimee then instead take the owner of the car to civil court.

Answer
Hello,

Yes you could but it could be very costly with no guaranty of an outcome.

If you have full coverage, turn the damage of your cat to your insurer.

You will need to pay the deductible which will be refunded after your insurance company subrogates.

I thought more into this and since you did not state if you had full coverage, the cheaper way to litigate would be through small claims court.
The only issue with using small claims courts is that generally there is a statutary cap depending on the state from $2,500-$5,000.

This won't help you if damages exceed those amounts.

If the other insurance company won't pay, you have every right to be made whole.
