QUESTION: About two years ago I borrowed my "friends" car. I ended up getting in a wreck, totalling his truck. He reported the truck stolen because he said USA Insurance would not pay any other way. He filed the police report 10 days after the wreck and the District Attorney, after reviewing the case, threw it out because he waited too long to file a report with the police and felt something was"fishy" about the whole situation. I was charged with auto theft, but as previously stated, the DA threw the case out.
Is this auto fraud? The cost of my insurance has risen do to the claim that was filed against me from his insurance company. Is there anything I can do to get this claim taken off of my record so my insurance will not be so much? It seems to me that this "friend" filed a false claim because I was not prosecuted. Should I contact his insurance company and explain to themthe events that transpired? Also, he was paid $24K by the insurancs company.

ANSWER: Wow! Both of you are amazing. I commonly try to help insureds that have been targeted by insurance companies. Guys like you make it hard for me to believe in my clients.

Its bad enough that I have to confront fraud in the insurance experts then I get to hear of your conspirital dishonesty and the nerve you have to complain about your insurance rates because of your bad decisions.


To top it all off, you want to set the blame on your goofball friend?

Filing a false police report is  a felony in most states and that is what your friend did! Then the two of you have another felony- fraud by conversion and insurance fraud, conspiracy to commit insurance fraud.

If I knew who you two goofs were, I would turn you both in and assist with your prosecution!


You have to be out of your mind coming on a public forum, admitting you and your friend committed multiple felonies and wanting me to feel sorry for you that your rates were so high, and have the gall to ask me for help! Then youhave the audacity to implicate your friend as being more complicit than you.

QUESTION: You are a moron. AS stated the DA felt I did nothing wrong. This guy filed a false police report. I have never gotten in any trouble in my life and you judge me? What a jerk! I am trying to right this guys "wrong". My simple question to your dumbass was...is it fraud what the guy did in filing a claim with his insurance company when I was not prosecuted because the DA did not believe the guy. This guy gets 24k and my premiums go up. I am trying to do the right thing here you jack ass. I did in no way conspire or anything else with this guy. I got into a wreck while driving his car...period. Charges against me were dropped.I am not setting the blame on anybobdy but myself...goofball!

I guess I hit a nerve.

When I answer these questions, it is with the limitation of the information supplied by the questioner. I respond as a volunteer and don't get compensated for my time.

I am very controversial because I don't go with the flow of the frauds in my industry. I am the only expert in my field in the country that dares oppose insurance companies successfully when they deny an auto theft claim.

You sir, have no clue what it is like to sit under constant threat of physical harm because I make the insurance experts I oppose look like blooming idiots. They take me as a real threat to their financial future.

You sir, have no idea as to what these opposing experts did in conjunction with a low life insurance attorney, to get me under federal investigation for 14 months turning my life upside down before the feds closed the case realizing they were set up.

I assure you, I am not scared of anyone or anything. My logo is the Phoenix and  it is a great metaphore as to how my life has gone since my last life of living on top of the world was destroyed by the corruption in my industry.

You sir have no idea of my knowledge of the criminal justice system which I have been involved with for 20 years as with the civil court system. Unfortunately, there have
been instances I was more knowlegable about the law than the attorney I was working for.

Lets assume for a minute that you are completeky innocent. Just because you were not linked to the reported theft, it does not mean there was no wrong doing on your part. The lack of persuing this case against you only means the DA did not have enough evidence to link you.

There is no law against stupidity though. Your response keeps referring to this guy as a friend. What the heck kind of friend throws another friend under the bus lije this.
If what you say is true and it were me, I wouldn't care about my insurance rates. I would do the right thing. I would turn this goof not only in to the insurance company, but to the DA's office as well and have nothing to do with him, because what else is he going to use you for?

Normally, I would not respond to such a flaming question, but I will not sit here and let some guy make such libelous remarks about me when you have no clue as to my background and who I am.

Some people like yourself do not care for my responses, and that's ok. You told me not to judge you and yet you are judging me.

I don't always give the answer people want to hear, but some people like that.

Bottom line,  I think you could probably get some relief from USAA by ratting this guy out, but even if you don't you get the satisfaction of doing the right thing. If you are silent, your friend got away with fraud leaving you with his consequences.

Apology accepted and yes, you could have been clearer. Your response made it appear like you had unauthorised use of the car.

You are concerned about turning him in as being vindictive. Absolutely not! He defrauded the insurance company and he filed a false police report. This is serious!

The man in my opinion should go to jail. Goofs like him cause everyone's rates to go up and as you saw in my first response, I don't tollerate insurance fraud.
