Auto Insurance Claims: Civil suit filed, Civil suit filed

Almost 1 year ago I was involved in an accident with one other vehicle. Both vehicles ran red lights with the other individual pulling in front of me and I collided with them. The police report stated the other driver was more at fault for pulling in front of oncoming traffic and the other drivers' version stated seeing me and pulling in front of me anyway. Both insurance companies claimed less responsibility than the other so we had a stalemate. Now I come to find that the other drivers' insurance company has filed a complaint and a civil suit against me. I have as yet to see the paperwork but what can I do?

Hello Randy,

You want to have your attorney press both insurance companies to pay for your damages and then figure out among them who pays who.

You are an innocent third party and thus, the burden to figure out how much is owed is on them. Your attorney can help you on that.

If they were to sue you civilly, they would have to serve you documents so you would know.
