Auto Insurance Claims: Pedestrian Accident - Claim Information Needed, value of injury claim

Question
A week ago I was struck by an SUV. I was crossing the street on a green light and the driver made a left turn and hit me.

I didn't lose consciousness however, I injured my right leg and arm. I was taken to the hospital via ambulance. No broken bones or major injuries. The follow day I had really bad shoulder and neck pains.

My question is - I called my insurance carrier and filed a claim. What should I expect next? I was told to go through the driver's insurance to pay for medical expenses since the 5K I am going to receive from PIP is not going to cover all the medical costs. Do I receive compensation from my own policy for bodily injury or only through the driver's insurance?  Any advice you could provide would be greatly appreciated.

Answer
Sylvia,

PIP is likely the only benefit you have that will cover medical expenses other than health insurance.  The other person's auto liability policy ought to be willing to settle with you quickly if you are reasonable about how much you injury is worth.

In summary, make a claim against the other person's auto insurance and continue using your PIP until it is exhausted.  The other person's insurance will not likely just pay bills, they will want to wait until you have completed all of your treatments and medicals and then they will offer a lump sum to settle the whole matter.  If you already know how much the medicals will likely be, you can ask to be paid for the medicals you have already incurred, the future medical, and pain and suffering.  Depending on what State this occurred in, the minimum amount of insurance available to you could be different.
