Auto Insurance Claims: Additional Damages Question, released?

Question
Hi,
I have a question regarding additional damages.  I suffered a heel fracture from my my accident.  After settling, I have been experiencing pain, swelling and tenderness in my ankle to the point where my orthopedic surgeon ordered an MRI on my ankle.   My additional medical bills are about 5K.  I'm wondering if I can ask for the cost of the expensive orthopedic shoes my orthopedic surgeon has suggested that I will need (lifelong) for heel and ankle support?  Also, I was prescribed otc NSAIDS and eventually prescribed stronger prescription strength NSAIDS for pain and swelling and due to the high dosage, I have experienced the negative gastrointestinal side effects.  I was wondering if I can ask for pain and suffering due to the side effects I've suffered from this medication?  I have 2 letters prepared from my OS stating all of the above.  Thank you in advance for your help.

Answer
Sharon,

I would have to see the settlement documents in order to be confident in my answer, but with that being said, it is normally not an option to go back and ask for more damages after a settlement.

I have never settled a claim where I did not get a signed "full and final release".  I would suspect you signed one of these, too, and if you did, you are out of luck.  If you didn't, simply present the claim and see what happens.
