Auto Insurance Claims: collision deductable waiver, uninsured motorists

On his way home from work my 17 yr old son hit a concrete barricade (no shoulder due to construction) to avoid collision with a truck veering into his lane. The driver did not stop and my son could not get a license number. It was dark. We informed Allstate immediately. They said they had no problem listing my son as not at fault but they refuse to utilize our uninsured motorist coverage ($250 deductible instead of the $1000 collision) because there was no contact with the other vehicle.  That means $750 extra for my son to pay -- a big deal for a hard working 17 yr old who is a responsible and careful driver.  Is there any hope of getting the collision deductible waived?

  Unfortunately, most uninsured motorist policies do indeed require contact to be made.  I have not seen anyone get Allstate to change their mind.  The law is on their side.  This is a common question, and sadly, the answer is not in the favor of the consumer.  There must be contact in order for uninsured motorist coverage to apply.
