Auto Insurance Claims: At fault insurance accusing me of lying, corporate giant, fault insurance

Question
Hi,

I got rear-ended while stopped at a traffic light. I went to the doctor a few days later after the accident, and now the other insurance is accusing me of making up a story. They did not believe that my injuries were from the car accident, and was told I did it to myself. Is that a common practice for insurance company to accuse someone of lying even though it is a legitimate claim?

I am very upset being call a "liar."

Answer
Grace,

Yes, to put it mildly, it's a pretty common practice for insurance companies to deny claims.  That's what they do.  It's how they make money.  I know it sounds strange but you have to understand that it's their business model!  Collect the most premiums and pay the fewest claims - it's that simple.

They're telling you you are not hurt but you know different.  Insurance companies call it malingering - faking an injury - and it's a very common accusation.  What can you do about it?  File a lawsuit against them and fight it out.  It's the only real weapon the individual has when faced with a corporate giant who is throwing their weight around.

I know it's not what you want to hear but a good old fashioned fight is the only solution when you're accused of malingering and you know you're in the right.

Best of luck,
