Auto Insurance Claims: Claim question, cement truck, winshield

I was following a cement truck that dumped it load and caused damage to my winshield and chips in my paint. The company has acknowleged fault and has said they will pay for the repairs. However they want to pay the repair shop directly. I am assuming they are not going thru their insurance company.  Can I insist they make the check payable to me and I decide when and where an if I get it repaired. Or should I get their insurance info and file a claim with them.

Hi Steve,

Yes. You are not required to have the vehicle repaired even though they are required to pay you for the cost of the repairs. You should tell thenm to issue the check payable only to you. And then you will decide when and where to have the repairs done.
