Auto Insurance Claims: Hit & Run Fraud, crash report, collision coverage

I was on the phone with my fiancee' while he was driving home one night and a guy pulled up on the side of him, we thought maybe the car had a flat tire or something, but the guy very angrily stated that my fiancee' was some guy at a gas station that he had an altercation with. My fiancee' says "Sir, im sorry but you have me mistaken for somebody else!" So I just told my fiancee' to drive off. My fiancee' then pulls off, and then the guy begins chasing him. So after i had heard what was going on I hung up and called 911 and told her what was going on, she asked for my fiancee's phone number, and she immediately called him back and assisted him and sent the police out to assist him. Come to find out the guy rear-ended my fiancee' which resulted into a crash totaling my car. My car is inoperable; while the other driver fled the scene. My boyfriend wasn't able to obtain the plate number because he was being chased but he did do a police report anyway about the color of the car and the description of the guy. I immediately filed a claim with my insurance agency, but my claim was denied because I didnt have comprehensive/collision coverage & because I didnt have the license plate number of the other driver. Three days later I gotta call from an insurance agent stating that I had backed into someone on the same nite and around the same time my car was hit. Their client had given them my license plate number. So I called my insurance agent back but I didnt get an answer so I left a message. I then proceeded with the other insurance agency by myself to prove that I didnt back into anyone but that my car was hit and that their guy did this. I provided the insurance agency copies of the police dispatcher tape of the emergency lady assisting my fiancee', a copy of the crash report, and a copy of my fiancee's police statement about what happened. While I was speaking to them on the phone, there were several things that matched up such as the color of the vehicle, and the color of the damages on the other driver's car. I just knew & thought that I had enough information to prove that I didn't back into anyone and to prove that it was there client that filed a false claim, but the insurance agency denied my claim! I was devastated. Because the only person that would have my license plate number is the person that rear-ended my fiancee'. That person filed a fraudulent claim. I tried contacting my insurance agent several more times & he never called me back? What should I do now? Should I get an attorney?

Hi Jane,

This is a very unusual situation. Since you do not have comprehensive and collision on your policy, your insurance company will not do anything to assist you.

In this situation about the only thing you will be able to do is to assemble as much evidence as you can and file suit againt the other party. You will heve to be able to prove that it was him that hit your car. You may want to hire an attorney to review all of your evidence before you file suit.
