Auto Insurance Claims: subrogation in volunteer situation, right of subrogation, volunteer organization

Question
If a volunteer during the course and scope of his or her volunteer work is involved in an auto accident and the volunteer's personal car insurance pays the claim, does that insurance company have a right of subrogation against the volunteer organization?

Answer
Matt,

Generally, unless there is a common law right to subrogation or a statutory/contractual right to subrogation, there is no such right. Here, it does not sound like there would be such a right in your situation.
