Auto Insurance Claims: dual backup accident ., veicle, wittness

While backing out of parking space,I was hit by another vehicle that was also backing up! My vehicle sustained damage to the passenger rear quarter and the other veicle had some damage to it's driver side rear bumper......My insurance co. Has decided that I'm at 51% fault and sent me a surcharge notice...I don't agree!!!... Should I accept this decision, or should I go through the surcharge appeal process. Thank You...

Hi Richard,

You can certainly try the appeal process, however, you will have to have some convincing evidence that you were less at fault. They made their decision based on the statements of the two drivers and the location of the damage on the vehicles. You will likely need an independent wittness or some other compelling information to win.
