Auto Insurance Claims: Auto Accident - possible fraud?, thurough, own insurance

I was in an auto accident about a week ago.  I filed a claim with the other drivers insurance immediately. Within an hour of the accident the owner of the car called my cell phone stating his brother was the one driving.  Now his insurance company states he filed a report aying his car was stolen.  The other driver gave the owner's info for insurance and told the towing company where to take the vehicle, I do not think that a criminal would be this thurough?  The police report verifies that it was the other driver's error.  Question,  is the insurance company liable for damages on the claim?

Unless the vehicle owner is willing to prosecute his brother for stealing the car, the insurance comapny can not deny coverage. He would have to prosecute his brother and ave him sent to jail. If he does this then the insurance comapny can deny your claim. If he does not do this then your claim should be paid. Be prepared for the fact that it may take a while to sort all of this out. You may want to make the claim through your own insurance just to speed up the process of getting your vehicle repaired.
