Auto Insurance Claims: Will our old car insurance take care of this?, insurance comapny, defence attorney

Two years ago, my husband was involved in a car accident (nothing serious). He was driving his friend's car. Recently, we found out that the person he hit, has filed a claim/law suit against my husband...just 2 days before statute of limitation expires.

Now, since my husband's work requires so much traveling and he so rarely actually uses his car, we sold his car over a year ago and he no longer has insurance. Will our old insurance company take car of this law suit since the accident happened while he DID have the car insurance?

Also, I'm not sure if it matters, but the accident happened in the state of LA, we are residents of CA and the person whose car he drove lives in DC...the person who my husband hit lives in some other state (not sure which).

Hi Veronica,

Auto insurance follows the vehicle not the driver. So it would actually be the friends insurance that would handle this. If no claim was ever filed your husband and his friend need to contact the friends insurance comapny at the time of the accident to report it. Inform the insurance company that a law suit has been filed. The insurance company will give instructions on what to do from there. The friends insurance company will provide your husband and the friend with a defence attorney to defend the lawsuit.
