Auto Insurance Claims: diminished value of vehicle, diminished value, state of utah

Question
does the state of Utah have the diminished value law for 3rd party?

Answer
Hi Theresa,

There is no legislated law regarding diminished value in any state in the country. All diminished value law is based on case law. There is over 75 years of case law that supports a 3rd pary claimants right to be compensated for diminished value.

You have the right to be made whole. If the repairs to your vehicle did not restore the value of your vehicle then you have not been made whole. The only way for you to be made whole is to be compensated for the diminished value of your vehicle.
