Auto Insurance Claims: Accident, I got ticket but not at fault, state department of insurance, department of insurance

In a recent accident, I was ticketed for improper lane change.  I went to court and was able to prove that this was the fault of the other driver by the tire marks left on my car from theirs.  The curvature shows that their wheel was turned towards me.  When I went to court, the ticket was dismissed.  I notified my insurance company and told them not to settle until I finished court.  They did not listen and paid based on the police report and the word of the other driver.  Now her insurance company will not talk to me and said it is closed because my company assumed fault.  What can I do to get this straight with my Insurance company and how do I get someone to pay to repair my car?

This is going to be a very difficult thing to unwind. First you will want to file a formal complaint against your insurance company with your state department of insurance. Explain everything that happened. Hopefully they will be able to help you to get both companies to reverse their decision.
