The at fault driver won't contact her insurance company. As a result the insurance company can not process my claim, what can i do? I am from Corpus Christi Texas.

Hi Nate,

If there was a police report you should obtain a copy of the police report and send it to the at-fault persons insurance company. If the facts of the accident and fault is clearly on the other person, the insurance company should be able to pay the claim. If they still will not pay you can do one of the following;

1) place the claim through your own insurance and they will pursue the at-fault person for reimbursement. Or

2) Obtain a repair estimate from the body shop of your choice then file a law suit against the at-fault person. If he does not respond to the law suit you should win a default judgement and you can then present the judgement to his insurance company for payment.
