Auto Insurance Claims: No Resolution to my Claim, auto insurance policy, collision coverage

I was involved in an auto accident about 2 months ago where I was making a left  hand
turn and the other party ran a red light. I was able to see her and braked when I did
although we did collide slightly. She claimed no injuries at the scene, nor did I or my
passenger. She also admitted fault at the scene. When I began my claim, I was told
that the other party was now claiming injury and that I was the party at fault. We have
been in the claims process since July 16th (date of the accident) and the other party is
refusing to have an inspection of her car and give a recorded statement per the advice
from her lawyer. I am aware that the claims process should take 30 days to be
processed from the date that the claim was made but since the other party is refusing
to give information about the accident, the investigation has been put on hold. I was
wondering if there is some kind of time limit to where the investigation goes
unresolved and what I can do, if anything, to speed up this process.

Hi Allie,

Since the other person has an attorney and is refuting liability, there is nothing you can do to speed things up. If you have collision coverage on your own auto insurance policy you should file the claim with your own insurance. They will pay for the repairs less your deductible. Then your insurance company will work out the liability situation with the other persons insurance and their attorney. If you do not have collision coverage you can either pay for the repairs out of pocket or just wait it out.
