Auto Insurance Claims: DUI Driver Hit my Wife while she was riding a bicycle, auto accident injuries, underinsured motorist coverage

Hi my wife was riding a bicycle yesterday with a friend here in salt lake city,
and a driver driving under the influence of alcohol hit my wife from behind.
My wife jumped out of the bike and crawled to the side of the road to save
herself from the car. The driver did not wanted to call the police, but my
wifes friend did that and police and ambulance arrived to the site. Then the
police found the driver had been drinking and was charged with a DUI plus
injury of a person I believe is the term. I took my wife to the medical center
and she stayed there, she has a broken coxis and was very lucky, thats what
the doctors said, the coxis would end up healing some time in the future. I
just got the insurance of the driver AAA, and I was wondering what should I
do next, hire a lawyer, call AAA and tell them what happened to open a case,..
Could you please explain what are the next basic steps for us to follow.?
My wife and her friend were riding their bicycles at the correct side of the
road, in line one in front of the other, with helmets and reflectors on the tail
of the bikes.

Hi Ed,

Because of the serious long term consequences of your injuries, I would also CONSIDER USING A DOCTOR'S NARRATIVE REPORT to assist in settling the insurance claims.

Cryptic notes may be medically significant, but why make the insurance adjuster struggle to figure out the significance of the injuries?  A narrative report or letter spells things out so the adjuster can see, read, and understand the doctor's diagnosis and prognosis and her record of the problems and pain and suffering you have endured.

Plus, narrative letters can tie together the trauma and its after-effects in a way that is authoritative.

We recommend that claimants almost always include some type of typewritten medical information to accompany to computer coded medical records and/or handwritten records. That is the first clue as to when to use the narrative report: if you are asking the adjuster to evaluate your claim on the basis of handwritten records and/or computer coded records that indicate diagnosis and treatment codes, then you need to supplement the record with a narrative report.

POLICY LIMITS SITUATION

I think that your wife's claim value could possibly exceed most insurance policy limits.  Hence, it is best early on to consider a POLICY LIMITS situation for the tortfeasor, resulting in an Underinsured Motorist Claim (UIM) against your policy.
What if the tortfeasor has coverage of only your state minimum insurance liability policy limits http://www.settlementcentral.com/page8008.htm?  Look up the state where the tortfeasor resides to see what the minimum liability insurance policy limits are.  

If it is something like 15/30, then that means that $15,000 is the bodily injury liability for one person in an accident, and $30,000 is bodily injury liability for all people injured in an accident.  Thus, if the tortfeasor has just the minimum, then $15,000 would be all that is available to your wife.  Same result if it is 25/50, except that the limits are $25K and $50K, respectively.

If that were all the insurance that is available, then you likely would be in a policy limits situation if your wife's doctor is predicting future problems with all of her injuries.  

The value of your wife's claim DOES GET A BUMP based upon the social hatred for the acts committed by the tortfeasor.  JURIES PUNISH DUI criminals.  Hence, you can expect some extra bump in value due to the despicable actions of the tortfeasor.

Always communicate with the adjuster in writing, showing your own analysis of value. It is OK I guess to have one call or so, but no more.   Always have your information and ammunition in writing to give to the adjuster.
