Auto Insurance Claims: geico settlement, rare muscle disease, myasenthia gravis

Question
Hello,
My daughter was sitting at a street light and was rear ended by a geico driver. I was told the driver had liability insurance only. (We live in Alaska, by the way.) My daughter had whiplash and a mild concussion. To complicate things she has a rare muscle disease. When she has any injury or stress to her body her Myasenthia Gravis attacks her body and shuts down muscle usage over her entire body. Six days after the accident she was hospitalized for a Myasthenic crisis and underwent a series of immuglobin infusions to help her regain her strength. While receiving the infusions she developed a side affect of Aseptic Meningitis and was on Morphine and Tordal for her pain. This lasted 3 days. Long story short, they gave her a very fair settlement for her car immediately, then we were told her case had to be moved up the ladder because of the injury. She is better now with no after effects, except severe nervousness when in a car. Today they called and offered her a settlement of 7500.00 on top of her 45000.00
worth of medical bills. Does this sound fair? we feel what she went through should give her a little more than that after the bills are paid. We haven't been through this before so any advise would help.
Thank you,
Shannon

Answer
Hi Shannon,

I'm sorry your daughter had to go through this.

Under the circumstances, with over $45,000.00 in medical bills, I think the claim is worth much more than $7500.00 over the medical bills. Even though she has a pre-existing condition, the onset of the attack was caused by the collision.

I think it would be in your daughters best interest for you and her to speak to a good (pitbull)personal injury attorney. This claim may be worth several times the total of the medical bills.

I hope this helps
