Auto Insurance Claims: Policy Limits, car accident injuries, personal injury insurance

Dr.
I was recently in a car accident in April. The other party was found at fault. I was rushed to emergency because the impact pushed me from driver side to the  side hitting the windshield. It has been determined that I have herinated disk in my L4 L5 and U1, and I just had Ulnar nerve surgery in my left arm. The person at fought had the min. of insurance coverage and my bills are getting ready to exceed their policy. I have already open a UM claim to pick up the rest, but I am concerned that it may not be enough and that I can not sue myself. What should I do?

Hi Chris,

You have a VERY SERIOUS INJURY, and please get some good professional information before you take any action toward settling your claim.  I think you need to consider three things:
#1. Should you accept the tortfeasor's policy limits or sue to take their assets?
#2. Can you get your health insurance and auto PIP or Med/Pay to waive subrogation?
#3. Make sure that your own health insurer and auto insurers have notice of your desire to settle with the tortfeasor and that you intend to fight their claims of subrogation.
#4. Are your UIM policy limits at least $100,000?  If not, better get some advice on whether there is some other tortfeasor you can bring in (i.e. bad roadway planning).

Always communicate with the adjuster in writing, showing your own analysis of value. It is OK I guess to have one call or so, but no more.   Always have your information and ammunition in writing to give to the adjuster.

Let him know that you are FIRM IN YOUR RESOLVE to get what you are demanding (NOT "asking", since that invites a counter-offer, but instead "demanding" as fair and reasonable compensation) by asking him what the options are to resolve the matter fairly should he not agree to a reasonable claim value. In other words, let him know that you will go through with a court filing if need be.

Remember these tips, do your homework, print out your evidence, show resolve to get your fair settlement, and you will DO JUST FINE.
