Auto Insurance Claims: HIT BY BIKE, bicyclist, reckless driving

I was driving home when a bicycle made a left turn in front of me.  In an attempt to avoid him I turned left and went through a ditch into a backyard.  The bicyclist went through my windshield and was severely injured as a result. He was cited for reckless driving and not wearing a helmet.  I live in Virginia and want to know my liability.  I contacted the insurance companies (I was driving a rental car) but no one seems to really care.  The man was not insured, had numerous alcohol related offenses, and has been threatening to sue.  Any advice?

Based on your description of the events, it sounds like you have no liability.

Any calls or letters you receive from the other person or an attorney should be referred to your insurance company. You should have no conversation with anyone about this accident except for your insurance company. If you do receive suit papers, contact your insurance company immediately. Your insurance company will provide you with a defense attorney if needed.
