Auto Insurance Claims: Financial responsibilty for an unsured motorist, minor fender bender, rental car reimbursement

I was recently in a minor fender bender where I was at fault and rear ended another vehicle.  It was so minor that we just exchanged numbers and I didn't think anymore of until she called me regarding her estimate for damages. I of course said I'd take care of it and to fax me her estimate. What exactly is my financial responsibility?  I offered to pay the collision center directly, but she insists I need to pay her directly based off one estimate.  I want to do the right thing, but I have a feeling she is not. Help. Do I have to pay her cash or is offering the pay for repairs directly to a third party fair?

Hi Angela,

Unfortunately, you must make the check payable to her directly. Although you are obligated to pay for the damage, she is under no obligation to actually have the repairs done.

I would suggest that you have a RELEASE form drawn up and require her signature on the release form witnessed by a Notory Public before you actually give her a check. That way she can not come back later saying the repairs cost more than the estimate or looking for rental car reimbursement. The release form should state that it is a full and fianl release of any and all claims related to the auto collision occuring on or about (date).
