Auto Insurance Claims: liability issue, own insurance, liability issue


Question
I am in Oregon and on Sunday I was driving on a two lane road and a woman was pulling out of a parking space (she whipped out of it without looking or had a blind spot) and she damaged the right side of my car. Her bumper has a small scratch. She believes it's my fault. She was also parked in a No Parking spot to boot! I had no way of avoiding her at all as she came out so fast and there was a truck coming down the other lane.

Suggestions? I do not at all believe I am liable. Do I contact the police?

Hi Eileen,

It's likely too late to contact the police now. Hopefully you obtained the other lady's insurance info. If so you should contact her insurance company to file a claim. They will do an investigation and will take a statement from you and the other lady. They will then make a liability decision. If yo do not like their decision, you can file the claim with your own insurance and they will work things out with the other insurance company.
