Auto Insurance Claims: Parking Lot Accident claims, parking lot accident, car damages

Question
Hello,

I own a Toyota Paseo 93 and recently I have parked my car in the parking lot and when I came back I saw ,
my car crushed between two cars ,which were parked beside mine. And the witness say that the red SUV has rammed the car beside be
sideways and it came on and hit mine and my car went on and hit the other car.So there were a series of three cars involved in that.
Cops have caught the guy who hit our cars and generated a report, but the problem is I just have a liability policy and my insuarnce agents
say that it all depend on the person and his insurance poilcy who hit the cars.So now I am confused even though I am no way involved in the accident
I have a damage and was wondering wheter my car damages will be covered on not. There are dents on both side with displaced trunck on my car and I feel
it would cross the actualy value of the car if it is covered. Please let me know whether I will covered or which way shall I approach to get
my claims.

Thank You
Manny

Answer
HI Manny,

This is a tough situation. The only thing you can do is to file a claim with the insurance comapny of the person who was at fault. If he has insurance, they will send an adjuster to inspect your car and wright a repair estimate. If the cost of the repairs will be more than 70% of the value of your car it will be determined to be a total loss. If this happens they will pay you the value of your car plus sales tax.

If he did not have insurance there is not much you can do other than to take him to court. But if he did not have insurance it is unlikely that he has any money you could get.

I hope this helps
