Auto Insurance Claims: accused of accident, now they have a witness?, insurance comapny, quiet neighborhood

Hi,

A few weeks ago I was at a friends house till around 10:30-11:00pm.  I left
with one of my friends at that time.  There were 3 cars along the curb.  The
guy whose house we were at, his girlfriend was parked behind me, and she
had just arrived and walked in the door as we were leaving, I was parked in
the middle, and my friend who I left with was parked in front of me.  We
pulled away and went home.  Next morning I have a message from his
girlfriend saying there is a dent in her hood and she thinks I backed up into
her car.  Well, this did not happen.  So I talk with the police to see what to do
and my neighbor who is a cop convinces me to just fill out a report saying I
may or may not have hit her car, steering me away from denying it and
having to go to court.  The insurance companies are now dealing with it, and
all of a sudden she says she has a witness that saw me do it... This is
impossible because it was late at night in a quiet neighborhood and she had
never mentioned a witness in the times we talked before insurance got
involved.  I do not know what to do in this situation and I believe she has had
a friend or someone pose as a fake witness. What can I do in this situation?

Hi Nick,

Hopefully you did not fill in the police report as the police told you. If you did then you just have to let the insurance comapny deal with it. If you did not, you need to adamantly deny that this ever happened. If she want to take you to court let her. If puts her witness up on the stand you can start asking th witness questions like,; exactly where wer you located when you saw this happen, what time did it happen, what was the whether like at the time, how far away were you at the time, do you wear glasses, what is your relationship to the vehicle owner, etc..

Also you should take pictures of the rear of your vehicle to show that there is no damage or paint transfer. Take a measurement of your rear bumper and compare it to her hood to show this is not possible.  

The reality is she will likely not pursue this in court. Just stand your ground and you should be just fine.
