Auto Insurance Claims: Insurance Co. dragging feet, state insurance commissioners, better business bureau

I was involved in an accident over two months ago.  After filing with his company, the other driver was convicted of improper driving, etc. and I was told by the adjuster on the case that he was 'recommending they [his company] accept liability'.  However, it really seems as though they are dragging their feet and I rarely, if ever, can get in contact with the adjuster on my case.  How long it "too long" for getting my car fixed?  Is there anything I should do (eg, suggest legal action or a better business bureau complaint) to motivate them to close the case and get my car fixed?

Hi Ken,

Two months is a long time. Most states require that claims be paid or denied within 30 days.

You should call the claims manager and ask what the hold up is. Tell him/her that unless the claim is settled immediately you will be filing a complaint with the state insurance commissioners office and may also file suit against their insured.
