Auto Insurance Claims: accident while parked, filing a police report, small claims court

My son and some friends were parked scattered around in a park after the prom and when they all decided to leave, one of his friends backed into his car. No police report was filed because his friend said he would take care of it, which the parents reiterated as well. The car had hidden damade of an additional $1000 making the bill now 2300 dollars and they are now saying it was my son's fault because he was behind him. They had been parked this way for an hour, and I contend my son was not at fault in any way. If he knew someone had been parked behind him, it was his responsibility to make sure it was gone. They are supposed to be having their insurance call me as no insurance information had been exchanged, but to this date have not.  Any ideas, and if civil court is the only answer, would I probably prevail. Thanks.

Hi Regina,

You should send a certified letter return receipt requested to the friends parents demanding that they provide you either with a check for $2300.00 or with complete insurance information withing 3 days so you can file a claim or you will be filing a police report of the incident.

If they do not respond or do no provide the info or a check then you can file suit in small claims court.

Another option would be to file the claim on your own insurance and they will try to get reimbursed bu the other people or their insurance.
