Auto Insurance Claims: other insurance says not enough info to determine whos at fault, car damage, collision coverage

I was involved in an accident in which I hit another car that pulled out of a drive way and began making a U turn in front of me. I was in the right-hand lane, she pulled out of driveway going same direction as I (two lanes both ways). I changed to left lane to avoid (I signalled, clear to change) hitting her, then suddenly her car was in front of me (no signal, not clear to change), almost perpendicular. I braked but car still moved forward and hit her where front door and rear door meet. My damage was from front fender to the right side of my car. Damage to suspension made my car not driveable, car was towed. Her car was as she moved it to side of road.

Well my question is, how can her insurance say they can't determine who's at fault until they get the police report. I filed claim with mine same day, then called her's the following day. i also issued a statement with my adjuster, which he says she's at fault from the details I gave him. I also gave a statement to her insurance. When my adjuster tries to get a statement from her, she refuses and says I'm at fault.

My problem is that's my only car, I'm using a rental for about a week now. My insurance will not pay for repairs, no collision coverage.

I'm out of money, can't get car fixed, I don't know what to do.

Hi John,

Since you and the other driver have conflicting stories, they will waite to get the police report to make a decision. Right now it is a he said, she said. The will try to see if the police report indicates who is at fault based on the statements given to the police officer at the scene. They will also look to see if anyone was issued a citation. By law the insurance company has 30 days to investigate the claim and to either pay or deny it.  You will just have to be a little patient. You can also try to obtain a copy of the police report yourself and send it to the insurance company. That may speed things up.
