Auto Insurance Claims: Insurance counter offer, jury verdicts, jury verdict

Question
I offered a counter offer of a settlement. The insurance company responded with this statement: Your demand is not within the range of our evaluation of the potential jury verdict. What does this mean?

Answer
Hi Leon,

The statement simply means that the insurance company monitors jury verdicts in your area for similar cases that have gone to court. The insurance company feels that if you file a law suit, a jury would not award you what you are asking for. The insurance company may be correct or they may just be bluffing to try to get you to settle for less.

You should respond back stating that their figure was unacceptable to you so you responded with a counter offer. If they wish to reject your offer they will need to make a counter offer themselves because you are not going to bid against yourself.

I hope this helps
