Auto Insurance Claims: Excluded driver, property insurer, car insurer

Accident occurred in Ca. An excluded driver just parked his vehicle and forgot to put his emergency brakes on. After he exited the vehicle it began to roll backwards and ended up hitting my wall. A witness confirmed the excluded driver was not driving. Will his insurance company cover this loss?

I think it is unlikely.  His negligence caused the accident, even if he wasn't in the vehicle when it hit your wall.  If I were you, I would ask them to cover it and see what they say.  Each state has different case law on questionable coverage issues, and sometimes the answer will differ by state.  You should also report to your property insurer, so they can handle if the car insurer does not.
