Auto Insurance Claims: pedestrian fraud, metro police, economic interest

In Jan. 2007, we were stopped awaiting to exit a casino, here in Las Vegas (our home of 30+yrs). When we deemed it safe and clear to proceed, my husband again checked, took his foot off the break, and CRASH.  A man had run into the passenger side of the car, ripping off the mirror.  He sprung to his feet and yelled "gimme $50.00".  When my husband said no, he demanded the carton of cigarettes on the seat.  Metro Police arrived on scene, but never spoke to us.  They inferred we were at fault, but explained it was private property, so no ticket.  He didn't want to, but was taken by ambulance.  He filed a lawsuit 5 mo. later.  HE was at fault, we need suggestions on how to fight this.  We are both in early 50's, fixed income, clean driving records.  Please help.

Hi Sue,
Your insurance company has the legal right to handle this matter by whatever method they deem least expensive.  You can not forbid them to pay the claim if they feel it's in their best economic interest, however, if they do pay, you can convince them to note the file that it was paid at the convenience of the company and will not beld chargable against you.
