Auto Insurance Claims: Abs unit, sheetmetal work, department of insurance

Question
Hello, My car got hit in at work in the parking lot. the insurance paid for the body repair and and is willing to to pay a portion of replacing the ABS unit which failed immediately after the car was hit. I want them to pay for the total cost but they are not budging.

Answer
Hi Ludi,
Unlike the sheetmetal work, the mechanical items in your car are considered 'depreciable', based on the age and mileage of your car.  However, it can be argued that the ABS, just like your airbags are not a mechanical item but a safety item.  It is illegal for your insurance company to return an 'unsafe' vehicle to the road. I suggest that you contact the Department of Insurance for assistance.
Just type 'yourstatename department of insurance' into your web browser and hit go.  This will bring up many sites in your state dealing with insurance. Scroll through them until you find the one that says 'official site' of the department of insurance, click on and scroll through it until you find out how to file a telephone and e-mail complaint, then file a complaint and request for help.
I hope this has been of assistance.
Your feedback by rating my answer will be appreciated.
Sincerely,
Bennie
