Auto Insurance Claims: accident, getting insurance, own insurance

I let my insurance lapse on my car so I did not have insurance but I was in the process of getting insurance and i let my mother n law borrow my car. She was in an accident That the cops says was her fault. the other man had to go to the hospital. The wreck happened at 3:46PM and the insurance company says my policy did not go into effect until 4:04PM. is there anything I can do?

Hi Crystal,
If your mother-in-law has her own insurance policy and the two of you do not reside in the same household, and this was just an occasional use of your car, then there is a clause in her policy that allows it to extend to cover her while driving your car.
If she does not fall under all these conditions, then you and her will be jointly responsible to pay for all the damage and injuries caused by this accident.  You are liable as the owner of the car and she is liable as the driver.
If all the conditions that I discussed do apply, then have her immediately make a report to her insurance company.  You will also have to provide them proof that you had no insurance at the time of the accident.
