Auto Insurance Claims: Multiple car accident liability, state of indiana, two witnesses

State of Indiana.  I was involved in a 3 lane interstate accident where I was in the right lane.  The driver in the left lane lost control of her car, hitting the center wall.  The driver in the center lane swerved to miss the driver in the left lane, entered my lane, and struck my vehicle, pushing me off of the road and into a fence.  I filed a claim against the driver who hit my vehicle only, initially.  When that insurance company indicated to me that they would only be covering a percentage of the liability for my damages I also filed a claim against the driver in the left lane, as the originator of the accident.  It has been a month since the accident and I have had to chase insurance both companies.  The company covering the gentleman who hit my vehicle contacted me yesterday and stated that, after consideration and having contacted two witnesses, they would be accepting no liability in the accident and considered the matter closed.

My insurance company, of course, will cover my damages; however, I will need to front my deductable until it is recovered, my rate will increase because I will loose my "claim free" discount, and I will not be covered for a rental while my car is in the shop.

I cannot imagine that the insurance company of the car in the left lane will propose covering 100% of my damages.  I was obeying the laws and was hit from the rear.  I have no liability.  I shouldn't have to pay a cent.  Suggestions?

Unfortunately, this is a common occurance. Insurance companies will deny liability and later will settle with your insurance company for a negotiated percentage. There is not much you can do here other than to be thankful that your loss is limited to your deductible and the loss of a discount.
