Auto Insurance Claims: responsibility, passenger tire, berkeley ca


Question
On Friday I was driving to a friends house in Berkeley CA.  I signaled a lane
change to the right, moved over, and began to turn into a gas station when a
car in the lane I had just moved into hit me, almost directly on the rear
passenger tire and wheel.  The damage was severe to my vehicle, although I
was able to drive it home to Ventura CA. the next day.  There was no police
report filed, and while I was kind enough to provide the man who hit me with
all the information, he did not give me the name or policy number for his
insurance company, and he claimed that he was going to hold me
responsible, despite his excessive speed.  Am I at fault?  And if not, what can
I do to get my car repaired and make sure that the other individual is held
responsible?

Hi Nate,

No matter how severe the accident, you should always call the police or at least demand that the other person provide you with their information.

At this point you will have to make the claim to your insurance company and if he makes a claim against you for the damage to his vehicle your insurance company will investigate and handle accordingly.
