Question
I lost my job and could no longer pay my comp and collision insurance.(full coverage) my insurance cancelled in September of 2011 and we are in February 2012...I was current with the payment...no lates or fees...up to date on the car payment...and on Saturday morning my vehicle was stolen and has not been found...I have no type of insurance and my debt is still within 5500 bucks....can the lender retroactively get "forced place insurance" to cover their losses....what is my options...I don't believe I will recover the vehicle..there is a police report...and I live in the state of California I sent this question dated 2-23-2012 thanks in advance on this matter

Answer
Nobody can get "retroactive" insurance to cover a claim after a claim has occurred. However, the lender should have been notified by the insurer and given the opportnity to continue the insurance payments for the amount of their interest, the loan balance. If the lender and insuer failed in that regard, in my opinion, you would only owe for any missed payments up to the time the car was stolen. Thats what a reasonable judge would rule, in my opinion. Unless your contract with the lender has an special provision addressing this issue. Read your contract with the lender "in case of loss" section/s etc.
