Auto Insurance Claims: multi car accident - rear ended, silver car, red cars

Question
I posted before, but put it under the wrong area. Here is the situation.Right before this part of the highway there is a 3 way split off. 2 cars ahead of me , one in the left lane (black car)and one in my lane(red car)and there was an empty lane to the right. The black car decided to go into the red cars lane causing them to swerve out of the way and they lost control of their vehicle fish tailing all over to the right lane and them back into mine and ended up facing the correct driving direction, but they were stopped. The black car kept driving and never stopped(there was no contact between the black and red cars) I was in full control of my vehicle and was able to stop with about a foot distance between my vehicle and the red car that was in front of me.(note that is was Me driving , wife and 3 children in the car) I didn't even notice what was going on behind me until we were rear ended. I was rear ended by a silver car and another silver car behind the silver car that rear ended me. The silver car that hit me was actually also stopped behind me with about a foot distance until the last silver car came up and pushed us all into each other. I know it is confusing. Now  i have front end and rear end damage.(rear from the silver car behind me and front from the red car in front of me (all 3 of us stopped still) How is any of this my fault? I was in control of my vehicle at all times and was able to stop my car from hitting the car in front of me and so did the silver car behind me. No damage was done until the last silver car came up behind us and hit us all. (and note that they had a GPS on their dash and were most likely watching that instead of looking at the actual road they were driving on due to the 3 way split). I think the Police are saying the cause of the accident was the black car from what they said at the time but i still haven't received the police report. Now i have to pay $500 in Hospital Co-pays and a $750 deductible to get my vehicle fixed and that's just the start of the medical. Like I said before..How is this my fault and now that i will be putting in a claim (as soon as I can actually come up with $750) will it be a mark on my record so my rates go up? Will i be able to get anything out of the one that actually caused all the damage?  thanks

Answer
Hi Mike,

Based on your version of the events, you are not at fault at all. The 2nd silver car is 100% at fault for all of the damage to all of the vehicles involved since he was the only one that was not able to control his vehicle.

You should contact the 2nd silver cars insurance company and make a claim. However, since there are several cars involved, it is possible he does not have enough coverage for all of the damage he caused. In that case you will have to make the claim to your own insurance company and then they will get a pro-rated reimbursement from the at-fault insurance company.

I hope this helps
