Auto Insurance Claims: Parking Lot Liability Question, metal spike, concrete block

Last night, we went to dinner and parked our car in one of the available spaces.  The concrete buffer at the front of the space had a metal spike that had caught on our front fender and we were unable to reverse the car out of the space without causing damage to our car.  We all got out of the car (there were 4 of us) but this made no difference.  We ended up having to jack the car but it still pulled the fender away.  I have photographs of the situation and a photograph of the huge metal spike protruding from this concrete block.  

I am about to track down the property manager for the parking lot - am I right in assuming that they are liable for this?

Hi Angela,

In most cases they would only be liable if they were aware that this situation existed. If other people had the same problem and made the parking lot owner aware and he did nothing to correct it, then he would be liable.
