Auto Insurance Claims: Parking Lot Liability, state of michigan, couple weeks


Question
I am in charged of the facilites of my company. An employee's car got damaged in the parking lot couple weeks ago because soemthing fell on it due to wind. We are in the state of Michigan.

Is the compnay liable for the damage caused because it was on our property?

Hi Nelish,

If the company knew, or should have known about the item that blew in the wind then yes the company would be liable.

If this was a something that noone in the company was aware of or should have been aware of then no the company is not liable.

Sometimes the difference is hard to see. If there is any question and the damage is minor, you should accept liability and pay for the damage. Then there is no problem with the employee continuing to work.
