Auto Insurance Claims: auto fatality, minimal insurance, minimal amounts

My son was a passenger on a motorcycle and there was a crash which resulted in my son,s death. The driver has been convicted of a Dui. I haven't made a call back to the claims person since I sent the paper establishing I am the mother. She did say the driver was insured for a very small amount. My question Do I have an option or do I have to settle for what he was insured? Thank you.

I'm very sorry for the loss of your son.

Often people who only have minimal amounts of insurance do not have any other assets to go after. It would be a good idea to speak to an attorney. They can do an assest check to see if this person has any assets or property, etc.. If they have no assets to go after, you may just have to accept the minimal insurance.
